Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Safetz LLC, doing business as Zinia Skye (“we,” “us,” “our”). They apply to ziniaskye.com (the “Site”), our free ebook, our newsletter, and any content we provide (together, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. About Zinia Skye

Zinia Skye is a virtual, AI-created personality, built by a team that has been working with generative AI since the early days. Zinia Skye is not a real person. Content presented by or attributed to Zinia Skye is created and published by us. Zinia Skye is managed by Awnian Media Group, a trademark of Safetz LLC.

2. Who may use the Services

The Services are intended for people who are at least 16 years old. If you are under the age of majority where you live, use the Services only with the involvement of a parent or guardian.

3. Education and entertainment only, not advice

Everything we publish is for general education and entertainment. It is not financial, investment, legal, tax, accounting, or other professional advice, and it does not create a professional or advisory relationship. Business decisions carry risk. Do your own research and talk to a qualified professional before you act. Examples, case studies, and lessons show what happened or what may be useful. They are not promises that you will get any particular result.

4. The free ebook and personal download links

• ✦We give you a personal, limited, non-exclusive, non-transferable, revocable license to download and read one copy of the ebook for your own personal, non-commercial use.
• ✦Your download link is personal to you. It expires after 7 days or a limited number of downloads. Please do not share it.
• ✦You may not sell, rent, lend, publicly post, upload to a file-sharing site, or otherwise distribute the ebook, its text, or its images, and you may not remove any notices from it. Short quotations with credit for commentary are fine.
• ✦We may change or stop offering the ebook at any time.

5. The newsletter

If you sign up, you agree to receive The Skye Brief and related emails from us until you unsubscribe. You can unsubscribe at any time using the link in any email. Signing up for the ebook also subscribes you to the newsletter.

6. Acceptable use

When using the Services, you agree not to:

• ✦break the law or infringe anyone’s rights;
• ✦submit false information, or use another person’s email address without permission;
• ✦use bots, scrapers, or automated means to sign up, to overload the Site, or to collect data from it (including harvesting email addresses);
• ✦try to gain unauthorized access to the Site, our servers, or other users’ information, or interfere with security features;
• ✦use the Services or their content to train or build a competing product, or to impersonate Zinia Skye or us.

7. Our content and accuracy

We work to make our content accurate, but it may contain errors or become out of date, and it reflects information publicly available when it was created. Companies, products, and markets change. If you notice a mistake, please tell us at support(@)ziniaskye.com and we will look into it.

8. Third-party names and trademarks

Our content discusses real companies and products. Their names, logos, and marks are the property of their respective owners. We are not affiliated with, endorsed by, or sponsored by them. We refer to them only to identify them for the purposes of commentary, criticism, and education.

9. Our intellectual property

The Site and the Services, including the name and character “Zinia Skye,” the logo, images, video, text, graphics, the ebook, and the design, are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except for the limited license in Section 4, these Terms do not give you any rights in them. You may not use our name, logo, or character in a way that suggests we endorse you without our written permission.

10. Feedback and messages you send us

If you send us feedback, ideas, or messages, you agree that we may use them without obligation to you, other than as our Privacy Policy provides for your personal information.

11. Links to other sites

The Site may link to third-party sites and social platforms. We do not control them and are not responsible for their content, practices, or availability. Your use of them is at your own risk and subject to their terms.

12. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT THE CONTENT IS COMPLETE, ACCURATE, OR SUITABLE FOR YOUR PURPOSES. Some jurisdictions do not allow certain disclaimers, so some of this may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SAFETZ LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

14. Indemnity

You agree to defend and indemnify us against claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or your breach of these Terms, to the extent the law allows.

15. Suspension and termination

We may suspend or end your access to the Services, or stop sending you emails, at any time if we believe you have breached these Terms or misused the Services. Sections that by their nature should survive termination will survive.

16. Governing law and where disputes are heard

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Riverside County, California, and you and we consent to the personal jurisdiction of those courts. Nothing here limits any consumer rights you have under the mandatory laws of your place of residence.

17. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the “Last updated” date. If you keep using the Services after a change takes effect, you accept the updated Terms.

18. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Services. If a part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a sale or reorganization.
